These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “Student”, “Visitor”, or “You”) and Mahal AI, operated by Sonika (“Company”, “Platform”, “We”, “Us”, or “Our”), governing your access to and use of all digital properties, educational materials, software systems, automation frameworks, online communities, downloadable resources, AI tools, products, and related services (collectively, the “Services”).
By accessing, browsing, purchasing, registering for, or otherwise using any portion of the Services, you expressly agree to comply with and be legally bound by these Terms, the Privacy Policy, Disclaimer, Refund Policy, and any additional policies published by Mahal AI.
1. Eligibility & Legal Capacity
By using the Services, you represent and warrant that:
- You are at least 18 years of age or are accessing the Services under lawful parental or guardian supervision.
- You possess the legal capacity to enter into binding agreements under applicable Indian law.
- You will use the Services only for lawful purposes and in compliance with these Terms.
- You are not prohibited from using digital educational services under any applicable law or regulation.
2. Nature of Services
Mahal AI provides digital educational resources, AI-related learning systems, automation frameworks, no-code implementation tutorials, downloadable assets, software workflows, templates, business productivity systems, and related informational content.
Mahal AI is an educational technology platform and does not provide accredited academic degrees, government-recognized certifications, regulated financial services, legal representation, employment guarantees, or investment advisory services.
3. User Accounts & Credential Security
Access to certain Services may require account registration and secure authentication credentials.
You agree to:
- Provide accurate, current, and complete registration information.
- Maintain the confidentiality of login credentials.
- Immediately notify Mahal AI of unauthorized account activity.
- Remain solely responsible for activities conducted through your account.
Strict Account Policy
Concurrent multi-user access, credential sharing, account resale, unauthorized dashboard distribution, VPN abuse, automated scraping, or suspicious access behavior may result in immediate suspension, restriction, investigation, or permanent termination without refund.
4. Intellectual Property Rights
All platform materials including but not limited to:
- Videos
- Templates
- Source code
- Prompts
- Automation workflows
- Design systems
- Brand assets
- Course structures
- PDF resources
- Frameworks and methodologies
are proprietary intellectual property owned, licensed, or lawfully controlled by Mahal AI and protected under:
- The Copyright Act, 1957
- The Information Technology Act, 2000
- The Trade Marks Act, 1999
- Applicable international intellectual property conventions
Purchase of a product grants only a limited, revocable, non-transferable, non-exclusive, single-user license for personal educational use.
Users shall not:
- Redistribute or resell content
- Upload materials to piracy platforms
- Conduct unauthorized group buys
- Copy or commercially exploit platform resources
- Reverse engineer protected systems
- Republish proprietary educational frameworks
5. Payments, Billing & Taxes
All purchases made through Mahal AI are subject to successful payment authorization through approved payment gateways and banking partners.
Users agree that:
- Pricing may change without prior notice.
- Applicable taxes may be charged in accordance with Indian law.
- Failure of payment authorization may result in denial of access.
- Chargeback abuse, payment fraud, or unauthorized transaction disputes may result in permanent account blacklisting and legal escalation.
Mahal AI reserves the right to verify suspicious transactions and request additional identity confirmation where reasonably necessary.
6. Refunds & Digital Product Policy
Due to the irrevocable nature of digital content delivery, downloadable resources, streaming educational materials, and instant-access systems, all purchases are generally non-refundable unless expressly stated otherwise in a separate written refund policy.
Users acknowledge that access to proprietary educational materials constitutes commencement of service delivery immediately upon purchase.
7. Prohibited Activities
Users shall not engage in any activity that may:
- Violate applicable law or regulation
- Compromise platform security
- Disrupt servers or infrastructure
- Transmit malicious software or code
- Conduct unauthorized scraping or automation
- Impersonate another individual or entity
- Infringe intellectual property rights
- Harass, abuse, or threaten staff or users
- Use the Services for fraudulent or unlawful activity
Mahal AI reserves the right to investigate suspected misuse and cooperate with law enforcement authorities where legally required.
8. Third-Party Services & External Platforms
Certain educational content may reference or integrate third-party software platforms, APIs, hosting providers, payment gateways, automation services, AI systems, communication tools, or external websites.
Mahal AI does not control or guarantee:
- Availability of third-party services
- Platform uptime or continuity
- Accuracy of external software functionality
- Future pricing or policy changes
- Data handling practices of third parties
Use of third-party platforms is undertaken entirely at the user's own risk and subject to the respective provider’s terms and policies.
9. Disclaimer of Warranties
All Services are provided on an “as-is”, “as-available”, and “best-effort” basis without warranties of any kind, express or implied.
Mahal AI expressly disclaims all warranties relating to:
- Continuous platform availability
- Accuracy of educational content
- Business outcomes or earnings
- Uninterrupted software performance
- Compatibility with third-party systems
- Freedom from bugs, vulnerabilities, or interruptions
10. Limitation of Liability
To the fullest extent permissible under applicable law, Mahal AI, its owner, affiliates, contractors, instructors, employees, licensors, agents, and representatives shall not be liable for any:
- Indirect or consequential damages
- Business interruption losses
- Loss of revenue or profits
- Data loss or corruption
- Cybersecurity incidents
- Third-party service disruptions
- Operational or technical failures
- User implementation errors
Aggregate liability, if any, shall not exceed the actual amount paid by the user to Mahal AI for the specific Service giving rise to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Mahal AI, its owner, affiliates, personnel, contractors, licensors, and representatives against any claims, liabilities, losses, damages, legal proceedings, penalties, costs, or expenses arising from:
- Your misuse of the Services
- Your violation of these Terms
- Your infringement of third-party rights
- Your unlawful activities or conduct
12. Suspension & Termination
Mahal AI reserves the unrestricted right to suspend, restrict, or permanently terminate access to the Services without prior notice if a user is suspected of:
- Violating these Terms
- Conducting fraudulent activity
- Abusing platform infrastructure
- Engaging in piracy or redistribution
- Threatening platform security
Termination may occur without refund where legally permissible.
13. Governing Law & Jurisdiction
These Terms shall be governed and interpreted in accordance with the laws of India, including but not limited to:
- The Indian Contract Act, 1872
- The Information Technology Act, 2000
- The Consumer Protection Act, 2019
- Applicable intellectual property and cyber laws
Subject to applicable law, all disputes, controversies, claims, or legal proceedings arising out of or relating to the Services shall fall under the exclusive jurisdiction of the competent courts located in Jaipur, Rajasthan, India.
14. Modifications to Terms
Mahal AI reserves the right to modify, amend, replace, or update these Terms at any time without prior notice.
Continued access to or use of the Services following publication of revised Terms constitutes acceptance of such modifications.
